In 2024, MGI International, LLC (MGI) voluntarily self-reported to U.S. Customs and Border Protection (CBP) and the U.S. Department of Justice (DOJ) concerns that it’s former Chief Operating Officer (“COO”) had directed MGI’s subsidiaries to report the wrong country of origin to CBP resulting in lower duty payments.
After a thorough investigation and proactive engagement with the government, DOJ’s Criminal Division resolved its investigation and declined prosecution of MGI and its subsidiaries based on MGI’s timely and voluntary self-disclosure, full and proactive cooperation, timely and appropriate remediation, and repayment of the unpaid duties, amongst other considerations. MGI is pleased that its full cooperation with the government’s investigation is reflected in the DOJ’s decision.
MGI’s former COO, David Guimond, has not been an employee of MGI or its subsidiaries since November 22, 2024. Prior to his departure, the former COO was on administrative leave from MGI and its subsidiaries since April 25, 2024.
